1. TERMS, CONDITIONS AND WARRANTIES
Hotel Transactions
The user agrees that his/her credit card will be charged for the full cost of the reservation upon submitting and confirming the reservation request. The cost of the reservation is the total of the indicated room rate multiplied by the number of days in the reservation, plus an additional amount for the tax recovery charges and service fees of KBS TOURS INTERNATIONAL INC If not stated at the time of the booking no other services (such as breakfast) are included.
The tax recovery charge is assessed to recover the amount KBS TOURS INTERNATIONAL INC. is to pay to the hotel in connection with the reservation for sales and use, occupancy room tax, excise tax, value added and other similar taxes, and the balance of the additional amount is a fee KBS TOURS INTERNATIONAL INC. charges in connection with the handling of the reservation and includes all finance charges as well. service fee varies based on the amount and location of the reservation.
KBS TOURS INTERNATIONAL INC. is not the vendor collecting and remitting said tax to the applicable tax authorities. The vendors bill all applicable taxes to KBS TOURS INTERNATIONAL INC. and such taxes are remitted directly to the vendor. KBS TOURS INTERNATIONAL INC. is not a co-vendor associated with the vendor with whom KBS TOURS INTERNATIONAL INC. books or reserve the customer's travel arrangements. Taxability and the appropriate tax rate vary greatly by location. The actual tax cost paid to the vendor may vary from the tax recovery charge, depending upon the rates, taxability, etc., in effect at the time of the actual use of the hotel, automobile, etc., by the customer.
The user may cancel or change the reservation in line with the booking cancellation rules and the rules of any other changes, stated on the website during the process of reconfirming the itinerary. The payment must be done in line with the rules and regulations stated on the reservation at the time of the booking.
Once the reservation is confirmed by the user and the payment information is transferred to the system in line with the dates stated on the site cancellation is permitted only until the date specified and is subject to a 1 Night Room and Tax penalty.
Cancellations
Cancellation charges will be applied in relation to the notice period between notification of cancellation and the date of stay at each hotel within a booking
Bookings, Payments and Confirmations
Bookings will be accepted on the web site until 24 hours prior to the date of arrival.
Bookings for travel arrangements made 10 days or less in advance must be paid for online and in full by credit card at the time of booking. This also applies to any additional charges for amendments made to bookings within 10 days of travel. Bookings for travel arrangements made 11 days or more in advance may be paid for either a) on line at the time of booking by credit card; or b) on line at any time not less than 10 days in advance of the date of the first service by credit card; or by bank transfer to the accounts c) in cash/check to be received at our company address no less than 10 days in advance.
In all cases, if payment is not received by 10 days before the date of the first service, we will assume that the booking is no longer required and we will cancel the booking. All payments must be made in full.

In the event that you make a double (duplicate) booking and wish to correct this, please send us an email by providing the reference of the booking you wish to keep before sending the cancellation to KBS TOURS INTERNATIONAL INC.
With these terms payment is considered as final sales.
Depending on the city and property the user may also be charged resort fees or other incidental fees, such as parking charges. These charges, if applicable, will be payable by the user to the hotel directly at checkout. When the user checks in, a credit card or, in the hotel's discretion, a debit card, will be required to secure these charges and any incidental fees (phone calls, room service, movie rentals, etc.) that may incur during stay.
The rates seen on the inquiry pages are subject to change until the final payment is received.
Late Arrival and Failure to Check-in on First Night
If the user is going to be delayed or find that cannot check in to the hotel on the date the user requested, the user should contact the hotel to let them know. If the user fails to check in to the hotel on the day of his/her reservation and do not alert the hotel, the remaining portion of the reservation will be canceled and the user is and will not be entitled to a refund. Refund policies may differ from hotel to hotel therefore, letting the hotel know does NOT mean a refund will be made.
Special Needs
If the user has special needs (e.g., wheelchair accessible room) the user must call the hotel and verify that special needs can be met. The hotel reservation will be refunded, canceled or modified if special handicapped needs cannot be met.
Frequent Traveler Points.
Frequent traveler points, upgrades, certificate vouchers and other discounts or incentives may not apply to KBS TOURS INTERNATIONAL Inca’s hotel service.
Travel Destinations
Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. KBS TOURS INTERNATIONAL INC. urges the user and therefore the passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government and by any other Government they find necessary prior to booking travel to international destinations . Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov.
Passports, Visas, and Hazards
KBS TOURS INTERNATIONAL INC. has no special knowledge regarding foreign entry requirements such as the need for passports and visas, unsafe conditions, health hazards, weather hazards, supplier bankruptcies, or the suitability for disabled persons of any portion of any tour. For foreign entry requirements, go to travel.state.gov/travel/foreignentryreqs.html. For State Department travel warnings and advisories, go to travel.state.gov/travel/warnings.html. For foreign health requirements and dangers, go to www.cdc.gov/travel/index.htm. The user hereby releases KBS TOURS INTERNATIONAL INC. its affiliates from any claims resulting in whole or in part from any problem covered in this paragraph and any other causes not within control. Please make sure that the travelers and the clients check such information through other sources depending on the departure location.
2. CURRENCY CONVERTER
If and when a currency converter is used on the site, the currency rates shown on the site are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes may not be updated every day. The day that currency was last updated is to be stated with the rates, and must be checked by the user before any references.
The information supplied by this application is believed to be accurate, but KBS TOURS INTERNATIONAL INC. does not warrant or guarantee such accuracy. When using this information for any financial purpose, KBS TOURS INTERNATIONAL INC. advises the customer to consult a qualified professional to verify the accuracy of the currency rates.
KBS TOURS INTERNATIONAL INC. does not authorize the use of this information for any purpose other than personal use and prohibit to the maximum extent allowable the resale, redistribution, and use of this information for commercial purposes.
3. AGE AND RESPONSIBILITY
The user is responsible for maintaining the confidentiality of his/her account information and password. The user agrees to accept responsibility for all activities that occur under his/her account or password. The user represents that he/she and the user’s client/clients are of sufficient legal age to use this site and to create binding legal obligations for any liability that may incur as a result of the use of this site.
The user warrants that he/she is at least 18 years of age and possesses the legal authority to enter into this agreement and to use this website in accordance with all terms and conditions herein. The user agrees to be financially responsible for all of his/her use of this website, as well as for use of his/her account by others. The user agrees to supervise all usage of this website by minors under the name or account of the user. The user also warrants that all information supplied by the user in using this website is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. The user agrees that the travel services reservations facilities of this website shall be used only to make legitimate reservations or purchases for the user or for another person for whom the user is legally authorized to act. The user understands that overuse or abuse of the travel services reservation facilities of this website may result in the user’s being denied access to such facilities.
Must be 21 Years of Age. At least one of the guests on the reservation must be adult and be 21 years or older to check into the hotel.
4. PRIVACY
In order to purchase travel and related services through this site, the user must provide KBS TOURS INTERNATIONAL INC. with certain personal information such as the user’s name, the credit card number, expiration date, billing address, the telephone number, the e-mail address and the name or names of the person(s) traveling as well as their necessary contact information of the user and of their clients if such clients exist.
If the user is making a reservation for one or more travelers, he/she will need to make sure that each of these other travelers agrees, in advance, that their personal information is disclosed to KBS TOURS INTERNATIONAL INC..
KBS TOURS INTERNATIONAL INC. has the right to provide certain of the user’s or his/hers client/clients’ personal information to the airline, hotel, car-rental agency, travel agency or other involved third party to enable the successful fulfillment of the travel arrangements.
KBS TOURS INTERNATIONAL INC. may use non-personally identifiable information in aggregate form to build higher quality, more useful online services by performing statistical analyses of the collective characteristics and behavior of customers and visitors, and by measuring demographics and interests regarding specific areas of the site.
KBS TOURS INTERNATIONAL INC. has the right to provide anonymous statistical information based on this data to suppliers, advertisers, affiliates and other current and potential business partners. KBS TOUR INTERNATIONAL INC. may also use such aggregate data to inform these third parties as to the number of people who have seen and clicked on links to their web sites.
From time to time KBS TOURS INTERNATIONAL INC. may add or enhance services available on the site. To the extent these services are provided and used, KBS TOURS INTERNATIONAL INC. may use the information the user provides to facilitate the service requested. Where client's stay is outside the European Economic Area (EEA), controls on data protection may not be as strong as the legal requirements in PDPR. KBS TOURS INTERNATIONAL INC will not however pass any information on to any person not directly responsible for travel arrangements.

The user or on the user’s behalf in excess of the liability described above; or
by third parties as a result of:
the user’s breach of this agreement or the documents referenced herein;
the user’s violation of any law or the rights of a third party; or
the use of this website by the user.
9. COPYRIGHT
All materials and content on this site, including, but not limited to, software, logos, trademarks, graphics, text, designs, compilations of data, video, typefaces, music, sounds, illustrations, designs, icons, hotel reports, photographs, images, maps, including the information, written and other material on this site are the intellectual property of KBS TOURS INTERNATIONAL INC. or its suppliers and are protected by international copyright law. The web user is granted a limited, non-exclusive, non transferable, revocable license to view these materials. 12. RELATIONSHIP
Third Parties
If the Site is used to submit Requests for or on behalf of a third-party ("Third-party"), such as a family member or a traveling companion, or a client, the user is responsible for any error in the accuracy of information provided in connection with such use. In addition, the user must inform the Third-party of all Terms and Conditions applicable to all products or services acquired through this Site including all rules and restrictions applicable thereto. Each User using this Site for or on behalf of a Third-party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third-party's or the User's failure to fulfill any of its obligations as described above. The user is directly responsible for any Request submitted including for total charges and performance obligations.
13. GOVERNING LAW.
This Agreement and its performance shall be governed by the laws of the state of New Jersey, United States of America, without regard to its conflict of laws provisions.
14. ATTORNEY'S FEES.
If KBS TOURS INTERNATIONAL INC. or its affiliates take any action to enforce this User Agreement and these terms and conditions, such parties will be entitled to recover from the user, and the user agrees to pay, all reasonable and necessary attorney's fees and any cost of litigation, in addition to any other relief, at law or in equity, to which such parties may be entitled.
15. INJUNCTIVE RELIEF
The user acknowledges that a violation or attempted violation of any of this User Agreement and these terms and conditions will cause such damage to KBS TOURS INTERNATIONAL INC. as will be irreparable, the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law. Accordingly, the user agrees that KBS TOURS INTERNATIONAL INC. shall be entitled as a matter of right to an injunction issued by any court of competent jurisdiction, restraining such violation or attempted violation of these terms and conditions by the user, or his/her affiliates, partners, or agents, as well as recover from the user any and all costs and expenses sustained or incurred by KBS TOURS INTERNATIONAL INC. in obtaining such an injunction, including, without limitation, reasonable attorney's fees. The user agrees that no bond or other security shall be required in connection with such injunction.
KBS TOUR INTERNATIONAL INC. reserves the right to comply with law enforcement requests or requirements relating to the use of this website or information provided to or gathered by the Company with respect to the use of this website. If any provision of this agreement is determined to be invalid or unenforceable pursuant to applicable law by any court of competent jurisdiction, the other provisions of this agreement will remain in full force and effect.
16. TERMINATION
KBS TOURS INTERNATIONAL INC. may terminate this User Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this site or the failure of the user to comply with these terms and conditions. Such termination shall not effect any right to relief to which KBS TOURS INTERNATIONAL INC. and its third party providers and distributors may be entitled, at law or in equity. Upon termination of this User Agreement and these terms and conditions, all rights granted to the user will terminate and revert to KBS TOURS INTERNATIONAL INC. and its third party providers or distributors, as applicable.
User access to all or part of this Site may be terminated or suspended at any time, without notice and for any reason.
17. ASSIGNMENT
The user may not assign, convey, subcontract or delegate his/her rights, duties or obligations hereunder.
18. MODIFICATION
KBS TOURS INTERNATIONAL INC. reserves the right to modify these terms and conditions and notices under which this website is offered at any time and the continued use of this site will be conditioned upon the terms and conditions in force at the time of use.
19. ADDITIONAL TERMS.
Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and the user agrees to abide by such other terms and conditions.
20. SEVERABILITY
These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

The headings used in this User Agreement are included for convenience only and will not limit or otherwise affect the terms and conditions herein.
22. ENTIRE AGREEMENT
This User Agreement, together with any terms and conditions incorporated herein or referred to herein constitute the entire agreement between KBS TOURS INTERNATIONAL INC. and the user relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
The user agrees that no joint venture, partnership, employment, or agency relationship exists between the user and the Company as a result of this agreement or use of this website. KBS TOURS INTERNATIONAL INC. reserves the right to comply with law enforcement requests or requirements relating to the use of this website or information provided to or gathered by the Company with respect to the use of this website.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
This agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between the customer and the Company with respect to this website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and the Company with respect to this website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
